Practice Areas

Marc helps clients reduce their legal risks from online practices and defends those practices in litigation and enforcement actions. He advises on issues related to ECPA, the Wiretap Act, FISA, privacy, VPPA, information security, and fantasy sports. Marc defends clients in privacy litigation class-actions, data breach cases, and responding to state AG and FTC investigations. He also helps clients prepare for and handle information security breaches. Marc often guides financial institutions and hedge funds through the legal issues related to alternative data, including web scraping and acquiring aggregated or de-identified data. Recently, he has also been advising on blockchain, cryptocurrency, and prediction markets. In 2015, Marc was appointed as one of five amici curiae to the FISC on national security and foreign intelligence matters. He holds a Top Secret security clearance.

Career

Between 2000-2010, Marc ran the Privacy and Security groups at Sonnenschein and Kirkland & Ellis. Previously, he was a prosecutor with CCIPS in the U.S. Department of Justice. After receiving his J.D. from Harvard Law School, magna cum laude in 1994, Marc clerked for Judge Mark L. Wolf of the United States District Court, District of Massachusetts.
