Jennifer Nijman and Susan Franzetti of NijmanFranzetti LLP have over 60 years of combined experience in all aspects of environmental law and litigation. After chairing the environmental practice groups at two of Chicago’s largest firms, the two formed NijmanFranzetti LLP in early 2008 in order to better serve their clients. In 2010 they welcomed Kristen Gale to the firm. Prior to joining, Kristen spent five years at the office of the Illinois Attorney General, Environmental Bureau, where she handled environmental enforcement matters. Vincent Angermeir joined the firm in 2014. He formerly was an enviromental consultant and after law schooled clerked for the Seventh Circuit Court of Appeals. NijmanFranzetti LLP handles environmental legal projects in the areas of water, land and air. The firm handles all aspects of environmental litigation defense and enforcement, including administrative and civil agency enforcement matters, private party actions for property contamination, and toxic tort cases. The firm has broad experience before the Illinois Pollution Control Board in enforcement matters, rulemaking proceedings, seeking variances and adjusted standards, and representing clients in permit appeals and siting hearings. NijmanFranzetti LLP provides targeted legal reviews of permit applications, prepares and files regulatory submissions, negotiates and submits environmental plans, oversees due diligence and Phase I and Phase II property reports, and handles day-to-day environmental regulatory counselling. The firm represents companies in Superfund matters and property remediation projects pursued under state clean-up programs.
Jennifer Nijman and Susan Franzetti have significant environmental litigation experience, including jury and bench trials and appellate practice in the state and federal courts. The firm acted as co-counsel on behalf of a chemical company in a jury trial in the U.S. District Court for the Northern District of Illinois regarding alleged breach of contract and fraud claims arising from the purchase of a chemical plant in Joliet, Illinois. After an eight week trial, the jury awarded approximately $41.7million to the firm’s client. The firm also served as environmental counsel to a waste company in a toxic tort case involving alleged property damage due to the historic operation of a landfill. Plaintiffs claimed negligence, nuisance, and trespass. NijmanFranzetti LLP successfully tried the case before a state court jury during a seven week trial. The jury entered a verdict for the defense and awarded no damages to the plaintiffs. The firm has represented potentially responsible parties in well over 100 federal and state Superfund sites across the United States, including almost every EPA region. The firm’s Superfund work includes acting as counsel to both groups of companies and individual clients, and involves negotiating orders and agreements for remedial investigation/feasibility studies, removal actions, and remedial design/ remedial actions.
Ms Franzetti has specific experience in Clean Water Act matters, representing both industrial and municipal dischargers. She has been extensively involved in the negotiation and appeal of NPDES permits, including mixing zones, whole effluent toxicity, use attainability analyses, 303(d) listing issues and other water quality and wastewater issues. She also represents municipal clients regarding combined and sanitary sewer overflow issues. She recently represented an energy client in a Clean Water Act UAA rulemaking proceeding initiated by the Illinois Environmental Protection Agency before the Illinois Pollution Control Board regarding the Chicago Area Waterway and the Lower Des Plaines River.
