Antitrust & Competition Law:
Serving as antitrust counselors as well as litigators for over 35 years, including as counsel for the plaintiff in the ground-breaking Spray-Rite v. Monsanto case. Attorneys have successfully defended insurers and financial institutions in nationwide class action lawsuits brought under the securities and antitrust laws as well as federal consumer protection and state consumer fraud statutes. Representing corporations, partnerships and individuals embroiled in a wide variety of complex business disputes that arise out of past or present business relationships, including claims for breach of contract, business fraud, breach of fiduciary duty and other business torts; or arise between business competitors, including statutory or common law claims for trademark infringement, trade secret theft, unfair competition and trade disparagement. Experience includes representing mortgage and credit insurers, issuers of variable annuities, credit reporting agencies, subprime consumer finance companies, banks, title insurers, real estate investment trusts, and individual officers and directors. Representative disputes include breach of contract, fraud, insurance coverage and consumer class actions. The firm recently represented a client in highprofile litigation throughout the US concerning mortgage and credit insurance policies involving aggregate exposures of hundreds of millions of dollars.

Representing domestic and foreign clients in complex reinsurance disputes involving areas such as underwriting, scope and applicability of arbitration clauses, placement disclosures, claim handling, retrospectively rated business, obligations to follow settlements, allocation of settlements, obligations under surplus share reinsurance contracts, excess of loss contracts, application of ultimate net loss and net retained line clauses, accounting for premiums and losses, agency, insolvency and finite reinsurance. In 2004, Butler Rubin created Women in Reinsurance™, an industry networking group.
