The Firm
Inspired by the tradition of the firm founded by Santiago Perez del Castillo in 1976 and in the importance of providing personalised timely legal services with a practical approach, PÉREZ del CASTILLO & Asociados was founded in 2012. The firm is especially well known for providing specialised labour, corporate and dispute resolution services to clients operating in Uruguay. The firm’s clients rely in its professionalism, day-to-day advice and commitment. The team of the firm complements the experience and reputation of distinguished attorneys with the practice update and dynamism of recognised and promising young professionals. The different characteristics of its members stimulate teamwork under shared objectives: the conviction that providing timely solutions addressing matters from a legal and practical perspective is the way to guarantee the stability of business. The lawyers of the firm work with technical rigor and a practical approach, setting strong personal and professional relationships with its clients. Last years’ Chambers Latin America reviews confirm the firm reputation by stating: “The lawyers at Pérez del Castillo & Asociados are very good; very technical, efficient and responsive” (2017); “The lawyers are dependable, clear in their advice and have a lot of knowledge. They are completely dedicated to the client” (2016). “The firm is excellent – it’s knowledgeable, understands the problems at hand and provides extremely fast responses that are concise and address the issue from a legal and business perspective” (2015).

Main Areas of Practice
The firm offers integrated legal services on a broad range of practice areas (including agribusiness, data privacy, environmental and renewable energy, family business, financial and banking system, insolvency procedures, investments, migration, notary services and real estate) but the main areas of practice are the following:

Corporate and M&A: PÉREZ del CASTILLO & Asociados offers comprehensive advice in a wide range of corporate law matters, such as, mergers, acquisitions and joint-ventures transactions, shareholders agreements, commercial contracts, corporate governance practices, due diligence operations, corporate reorganisations, bankruptcy and liquidation proceedings.
The firm provides assistance to foreign companies willing to operate in Uruguay throughout their incorporation process advising them on the suitable legal structure that meets their needs, assisting in compliance, legal and regulatory requirements, and management of work permits, visas and residency documents needed for foreign workers.

Labour, Employment & Social Security: The firm is especially renowned for its extensive experience in labour, employment and social security matters. The firm’s qualified attorneys provides timely day-to-day assistance and advice in a broad variety of individual and collective labour relations topics, conflict prevention (mainly through the implementation of labour practices, policies and negotiations with unions and the government offices), labour dispute resolution through collective bargaining and labour litigation. The reputation of the firm in the market is also due to its practical memorandums and workshops, and its experience in both restructuring procedures and labour audits.
Although the firm is involved in international matters, the focus on national concerns is a distinctive feature that distinguishes it in terms of knowledge, understanding and practice in national labour relations and its main actors (union and chambers’ representatives, authorities of the Ministry of Labour and Social Security, judges, etc.).
The firm members expertise is reflected in several practical handbooks and papers published by the firm partners and associates covering the most relevant aspects of labour, employment and social security law, which are ‘best sellers’ in Uruguay and that inspire both court rules and business managers.

Litigation, Arbitration and Dispute Resolution: The firm has extensive practice and experience defending both companies and individuals in labour, civil and corporate (bankruptcy and enforcement proceedings) litigation procedures, as well as in administrative proceedings before government agencies and the Administrative Court.
The professionals of the firm participate in corporate conflicts between companies, or its shareholders or directors, acting as private arbitrators and mediators. They also intervene in labour dispute resolution proceedings between employers and employees, and in collective bargaining with unions and the government seeking to resolve both individual and collective conflicts.
