A Solicitor Advocate specialising in high value catastrophic injury and fatal claims. Carly has worked in the personal injury field for 10+ years and heads up BTO's catastrophic injury claims team. Areas of expertise include head/brain injury, severe spinal conditions, amputations, psychiatric and psychological disorders and a large number of fatalities. Carly is part of the Marine, Energy & Ports team acting on behalf of international insurers and P&I Clubs in relation to personal injury actions including off shore incidents. Experienced in dealing with jurisdictional and cross-border disputes throughout Europe and beyond. Carly provides advice and assistance to insurers on how best to protect their position in terms of the potential civil claim, and as a liaison between the Police/HSE and the Crown Office and Procurator Fiscal Service in terms of potential prosecutions and/or Fatal Accident Inquiries. Works closely with BTO’s Health & Safety Team on cases which result in prosecution, utilising the information obtained to assist proactive management and either repudiation of, or settlement of, any civil claims arising from the same incident. As a result of being instructed at the outset of a case, Carly is able to intervene early and assist clients with the investigation and analysis of both liability and quantum. Carly successfully secured an exit for her clients from a court action in which the sum sued for was in excess of £2m with her clients paying nothing. She was one of only two Scottish lawyers to be asked to present at the London Stock Exchange where she presented a talk on Scottish fatal claims and the disparity between awards made north and south of the border.
