Partner and Solicitor Advocate who jointly heads up a team of lawyers dealing with high value, catastrophic injury and fatal claims. Carly has worked exclusively in the personal injury field for 15 years. Experienced in dealing with cases involving fatalities and injuries such as head/brain injury, severe spinal conditions, and amputations, psychiatric and psychological disorders. Part of the marine, energy and ports team acting on behalf of international insurers and P&I Clubs in relation to personal injury actions, including off shore incidents. Experienced in dealing with jurisdictional and cross-border disputes throughout Europe and beyond and works closely with a global network of lawyers and experts to protect her clients’ position, whilst offering proactive and cost effective advice. Routinely instructed at the outset of a claim to provide advice to insurers on how best to protect their position in terms of the potential civil claim, and as a liaison between the Police/HSE and the Crown Office and Procurator Fiscal Service in terms of any potential prosecution and/or Fatal Accident Inquiry. Works closely with Health & Safety Team colleagues on cases which do result in prosecution to assist with proactive management and either repudiation of, or settlement, of any civil claims arising from the same incident. As a result of early intervention at the outset of a case, Carly is able to assist clients with the investigation and analysis of both liability and quantum and to develop a strategy for reaching satisfactory conclusion. Successfully secured an exit for clients from a court action in which the sum sued for was over £2m, with her clients paying nothing. Successfully appealed a fatal case which reaffirmed the law in relation to claims made by secondary victims. Regularly presents to clients and non-clients including a talk on Scottish fatal claims and the disparity between awards made north and south of the border at the London Stock Exchange.
