Over 20 years’ experience in personal injury work (18 years at the Bar). Recent experience includes:- fatal accident claims; catastrophic road traffic claims; claims involving serious head and brain injury; stress at work cases. Has appeared in the Supreme Court (as Senior and junior); the Inner and Outer House of the Court of Session; Sheriff Appeal Court and Sheriff Court.
Recent reported cases include:- Anderson v Imrie  CSOH 171 (proof on liability and quantum involving brain injured child; under appeal); Grubb v Finlay  CSOH 81 (proof of claim involving alleged chronic pain and ‘fundamental dishonesty’; under appeal); Hall-Craggs v RHASS 2016 SLT 311 (relevance of health and safety conviction in motion for summary decree).
In addition to personal injury work, Kay is experienced in clinical and professional negligence, judicial review, human rights law and statutory appeals. Recent reported cases include:- Khan v General Pharmaceutical Council  UKSC 64 (amicus curiae in appeal against professional regulators’ sanction); Trump International Golf Club Sc Ltd v Scottish Ministers 2016 SC (UKSC) 25 (judicial review of consent to windfarm application); Hunter v Scottish Ministers 2016 SLT 653 (judicial review - age discrimination in maintenance loans, public sector equality duty).
