With such principles in mind, the firm is pleased to announce the strengthening of its team within the past years through the new incorporation of: (i) Mr. Mario Reggiardo, as new partner in the dispute resolution – arbitration area; (ii) Ms. Lucía Villarán and Mr. Pablo Mori both as Senior Associates in the Regulatory & Competition and the dispute resolution - Arbitration areas respectively; (iii) Ms. Maribel Aparicio as Associate in the dispute resolution – arbitration area; and the promotion of (iv) Ms. Andrea Cadenas and Ms. Fiorella Zumaeta, both as Senior Associates in the regulatory and competition area; as well as (v) Economist Ms. Gabriela López as Senior Associate and Chief of the Economic Consulting area.
MAIN AREAS OF PRACTICE:
Competition/Antitrust, Public Law & TMT: The firm combines legal and economic theory to provide specialised advice in the application of antitrust rules in regulated markets. It is also pioneer and has extensive experience in the application of mechanism is such as leniency and commitments to cease activities in antitrust matters. This team is formed by economists and lawyers expert in both legal and economic theory. Partners are former members of various decision-making and supervisory bodies for free competition and economic regulation in Peru, and regularly act as counsel in proceedings brought before those organisations, mainly in telecommunications, energy and public transportation infrastructure. Thus the firm has gained know-how in topics such as tariff, interconnection, access conditions regulation, and in controversies between regulated companies. The firm also has extensive experience in areas such as free competition, unfair competition, removing bureaucratic barriers, and consumer protection. Finally, members of this team have actively participated in drawing up the legislation related to these topics.
Dispute Resolution: Arbitration, Insurance, & Civil & Corporate Law: As counsel, the firm has extensive experience at both local and international levels in designing effective and comprehensive legal strategies. Members of this team take a cross-functional approach including economic analysis and focusing on the cost-benefit ratio of the various aspects each case involves. Members have been counsel in various domestic and international arbitration proceedings in matters related to construction, gas supply contracts, energy distribution, telecommunications, general risk insurance and general contracts. This team has taken part in controversies linked to international contracts signed based on FIDIC model construction contracts and subject to ICC, CIAC, UNCITRAL and other international arbitration rules.
Members of this team also usually act as arbitrators at both domestic and international levels in different types of controversies related to commercial disputes, breach of shareholders’ agreements, or issues linked to construction contracts and contracts for supply of godos.
Finally, the firm provides specialised advice in corporate affairs in all kinds of corporate legal processes regarding insolvency, restructuring and liquidation of companies. Members of the firm act as facilitators in negotiations between debtors and creditors, designing plans for corporate restructuring or liquidation agreements. Members of this team have extensive experience in cases related to contracts, property, torts and privatisation.
Economic Consulting: The firm is distinguished for having a team formed by economists who solve complex problems with a quantitative and qualitative economic analysis complemented with a legal approach, offering innovative solutions to their clients. For example, assessing projects for obligatory merger control in Peru; estimating fines and damages in anticompetitive conducts; advising in processes of regulatory tariff for firms belonging to maritime transport, transport of hydrocarbon and natural gas sector; etc. In relation to judicial, arbitral and administrative proceeding, this area provides economic interpretation of concession contract of transport infrastructure; estimates damage and compensations in contractual controversy; assess distortions in the Hydrocarbon Market in Peru; among others. This area also provides economic advice to different national and international bodies about institutional reforms matters such as: advice to reform the Electricity Concession Act to promote investment in Peru, reform in the schemes of resources allocation, among others
