Commercial Litigation:
The firm’s litigation specialists, consisting of four partners and three associates, represent clients before all Austrian courts. The practice covers all fields of commercial disputes, including in particular corporate, post-M&A, agency & distribution, unfair competition and banking & finance.
Recent work highlights include the:
■ Representation of a shareholder in a shareholder dispute in an arms company
■ Representation of a large Austrian company in the furniture business in a corporate finance dispute
■ Representation of an Italian client in setting-aside proceedings before the Austrian Supreme Court
■ Representation of a Romanian energy company in two parallel proceedings regarding the issue of interim measures

Investment Arbitration :
The firm regularly advises clients in investment disputes. The team consists of four partners, one of counsel and three associates. It represents both governments and foreign investors before international tribunals in disputes under bilateral investment treaties.
Recent work highlights include the:
■ Representation of a South-Eastern European state in an investment arbitration under ICISD;
■ Representation of an Eastern European state in an investment arbitration under UNCITRAL Rules administered by ICSID
■ Representation of an Easter European state in two investment arbitrations under the Stockholm Rules

The practice covers all areas of individual and collective employment law. The team consists of two partners and three associates. The full attention of the employment partners Hans Georg Laimer and Martin Huger lies on the personal service of their clients. They support their long-standing clients in their day-to-day employment issues and assist employers in M&A and restructuring matters from an employment perspective. Furthermore, they advise on the full range of industrial relations law, representing employers also against trade unions and works councils. Having built up sustainable relationships with their clients over a decade, the partners have gained in-depth knowledge of their clients and their respective industries. The partners are working together closely. This allows the clients to always having a seasoned advisor easily available. The strong position of’ employment team within the Austrian market is apparent also by the high profile of their long-standing clients and further underlined by the large number of new employment mandates – covering potent clients from all industries – newly acquired by the employment team.

Compensation & Benefits:
The employment partners assist clients with the implementation of bonus-, commission-, or other benefit schemes. This starts with the drafting of employment contracts but also covers car policies, as well as advice and drafting of clauses regarding individual remuneration, overtime arrangements and all-in-remuneration. Furthermore, the team assists employers in harmonisng local contracts with group policies.

The partners advise clients on the implementation of and changes to occupational pension schemes and pension commitments.

Employment Litigation:
The employment team regularly defends clients before employment tribunals, including the Austrian Supreme Court. The partners’ thorough understanding of the legal and psychological elements of court disputes are key in these proceedings. Recent cases include the representation of a large multinational (one of Sweden’s largest family-owned corporate groups) against the former employees in four pending employment tribunal cases of white collar crime and the representation of a large multinational firm in the chemical industries against former employees in pending disputes regarding occupational pensions. Furthermore, the partners regularly defend clients also in court cases on discrimination issues.
