The firm’s litigation specialists, consisting of ten members, represent clients before all Austrian courts. The practice covers all fields of commercial disputes, including in particular corporate, post-M&A, agency and distribution, unfair competition and banking and finance.

■ Representation of shareholder in a shareholder dispute in an arms company
■ Representation of a large Austrian company in the furniture business in a corporate finance dispute

Investment Arbitration:
The firm regularly advises clients in investment disputes. The team consists of four partners, one of counsel, three attorneys at law and four associates. It represents both governments and foreign investors before international tribunals in disputes under bilateral investment treaties.
Recent work highlights include:
■ Representation of an South-Eastern European state in an investment arbitration under ICISD
■ Representation of an Eastern European state in an investment arbitration under UNCITRAL Rules administered by ICSID

Employment:
The practice covers all areas of individual and collective employment law. The employment team consists of five dedicated employment specialists, comprising one partner (Hans Georg Laimer), one attorney at law (Lukas Wieser) and three associates. The employment team supports its longstanding clients in their day-to-day employment issues, represents them before court and assists employers in M&A and restructuring matters from an employment perspective. Furthermore, it advises on the full range of industrial relations law, representing employers also against trade unions and works councils.
Recent work highlights include:
■ Supporting a world leading chemical company in all employment related aspects of a M&A deal (TUPE), comprising also advice in respect of information and consultation requirements
■ Advising a world leading chemical company in relation to the complete overhaul of its working time arrangements (including the negotiation and adjustment of their flexible work time arrangements with the works councils and their contractual arrangements with their field force) for all group companies in Austria

Compensation & Benefits:
The employment team assists clients with the implementation of bonuses, commissions, or other benefit schemes. This starts with the drafting of employment contracts but also covers car policies, as well as advice and drafting of clauses regarding individual remuneration, overtime arrangements and all-in-remuneration. Furthermore, the team assists employers in harmonising local contracts with group policies.
Recent work highlights include:
■ Assisting a multinational car manufacturer with respect to the changes to their bonus program, their car policy and the adjustments to their overall incentive structures
■ Supporting a global human proteins manufacturer regarding the changes in the employee’s classification in the client’s overall salary scheme.

Pensions:
The employment team advises clients on the implementation of and changes to occupational pension schemes and pension commitments.
Recent work highlights include:
■ Assisting a world leading chocolate producer and retailer on all Austrian employment law and pension law related issues in connection with a TUPE situation.
■ Supporting a major Austrian insurance company in the negotiation of the terms of the settlement, including pension issues, with the outgoing chairman of the board.

Employment Litigation:
The employment team regularly defends clients before employment tribunals, including the Austrian Supreme Court. The partners’ thorough understanding of the legal and psychological elements of court disputes are key in these proceedings. Recent cases include the representation of a large multinational (one of Sweden’s largest family-owned corporate groups) against the former employees in four pending employment tribunal cases of white collar crime and the representation of a large multinational firm in the chemical industries against former employees in pending disputes regarding occupational pensions. Furthermore, the partners regularly defend clients also in court cases on discrimination issues.

Employment Litigation:
The employment team regularly defends clients before employment tribunals, including the Austrian Supreme Court. This support comprises the full range of court cases, including, amongst others, claims of unfair dismissal and re-instatement, wage-and-hour claims, as well as discrimination claims.
Recent work highlights include: 
■Representing a leading Austrian contracting business against a former manager in three pending law suits before an employment court. The cases involve discrimination issues, wageand- hours claims, a claim of an undue motif for termination and a request for re-instatement
■ Successfully defending a multinational car manufacturer in a case of alleged sexual harassment against potential claims of one of the employees involved
