The most prominent precedent cases are: Swedish shipbuilding company Stena RoRo AB vs. Russian shipyard Baltiysky Zavod JSC, which totally changed court practice on the application of the ‘public policy clause’, and Norwegian shipbuilding company Odfjell SE v. Russian shipyard OJSC Sevmash, where we successfully recovered over $50 million for our client. The position elaborated in the above cases by the Russian Supreme Commercial (‘Arbitrazhny’) Court has subsequently been included in its official clarifications for the lower courts.
