Shaw Fishman focuses on and specializes in three areas of commercial law: bankruptcy and restructuring, litigation, and real estate. Main Areas of Practice:
Bankruptcy: The firm concentrates its practice on bankruptcy, reorganization, creditors’ rights, insolvency, crisis management, and related transactions and litigation. The Bankruptcy and Insolvency Group has depth of experience in all phases of complex bankruptcy and reorganization cases, as well as state and federal court receiverships and out-of-court workouts. The firm has substantial experience in all elements of bankruptcy litigation, including cash collateral and debtor in possession financing issues, modification of the automatic stay, contested plan confirmation hearings, and the prosecution and defense of fraudulent conveyance and preference avoidance actions. Shaw Fishman has extensive experience with respect to the purchase and sale of assets in both formal bankruptcy cases and out-of-court insolvency situations. The firm routinely represents debtors, debtors in possession, trustees, committees, and creditors in large national cases and smaller regional and local situations. In 2012, Ira Bodenstein was appointed the Chapter 7 Trustee of Peregrine Financial Group, Inc. and the firm has been engaged as the Trustee’s counsel, handling the multiple investigations, the claims review process, the administration of the case and the numerous pieces of associated litigation. Members of the Bankruptcy and Insolvency Group are frequent lecturers and authors on numerous bankruptcy and insolvency topics. The co-chairmen of the firm’s Bankruptcy and Insolvency Group, Robert M Fishman and Steven B Towbin, are Fellows of the American College of Bankruptcy. Robert M Fishman is a past President of The American Bankruptcy Institute (1997-8) and Brian L Shaw will become President of the ABI in 2014.
Commercial Litigation: The Commercial Litigation Group has experience in all aspects of state and federal commercial and tort litigation, including contract claims, fraud claims, labor and employment disputes, products and premises liability claims, franchise disputes, professional negligence, securities and commodities fraud, insurance coverage disputes (from the policy holder side), partnership and shareholder disputes, mechanics lien actions, and construction and real estate disputes. The Commercial Litigation Group also lends continual support to our Bankruptcy and Insolvency Group through its extensive involvement in the numerous adversary proceedings handled by the firm, such as preference and fraudulent conveyance cases.
Real Estate: The Real Estate Group provides representation with respect to all aspects of commercial and residential real estate. The firm has a very significant real estate development practice, involving acquisitions, land use and entitlement, planned developments dispositions, financing and leasing.
Mediation: Robert M Fishman is now regularly being retained as a mediator in various bankruptcy disputes across the United States. Mr Fishman was a member of the faculty for the 2012 and 2013 American Bankruptcy Institute St. John’s University Law School Bankruptcy Mediation Training Program.
The Bankruptcy and Insolvency Group regularly represents trustees, committees, financial institutions, equity holders, landlords, asset purchasers, plan liquidating and disbursing agents, assignees, and receivers. Clients of the Bankruptcy and Insolvency Group consist of companies from numerous industries throughout the United States, including the manufacturing, healthcare, retail, entertainment, telecommunications, financial and real estate industries. The Commercial Litigation Group represents clients in various jurisdictions across the country, including banks, printing companies, venture capital firms, real estate developers, hotels, manufacturing companies, retailers, and bankruptcy trustees, committees, and estates. Clients of the Real Estate Group include developers of shopping centers, office buildings and residential projects throughout the greater Chicagoland area.
