Securities Litigation:
• Carter’s Inc. (global clothing retailer): secured the first non-prosecution agreement with the SEC since the announcement of the SEC’s new cooperation initiative
• CBRE Realty Finance Inc.: secured dismissal of all claims in a shareholder class action challengin the company’s IPO. The Second Circuit affirmed the decision in 2011, clarifying important issues concerning the materiality standard applicable to ’33 Act securities claims
• Jones v Harris: prevailed for client and for the mutual funds industry at US Supreme Court using innovative legal argument and setting a desired standard for determining how so-called ‘excessive fees’ against mutual fund advisers could be litigated

Government Enforcement:
• Stryker Biotech: secured the dismissal of all 13 felony charges against client following opening statements in exchange for a fine and a plea to a single misdemeanor count, and helped secure the dismissal of all charges against the former Stryker Biotech President and three Sales directors, in a closely watched trial involving alleged off-label marketing of a bone growth product
• IASIS Healthcare: following two previous with prejudice dismissals, negotiated a no-cost resolution to a six-year qui tam lawsuit brought by a former employee against IASIS Healthcare, obtained a finding of ethical misconduct against the former employee, and obtained sanctions against opposing counsel for their own ethical misconduct
• Lauren Stevens: obtained a judgement of acquittal at the close of the presentation of the government’s case for a former GSK Assistant General Counsel who was charged with obstruction of justice and making false statements in connection with an FDA inquiry into the company’s marketing practices
