Family/matrimonial : An Introduction

Prenuptial Agreements

The most far-reaching development of the year was the Supreme Court’s decision in Radmacher. The ruling on the weight to be attached to the prenuptial agreement between the German heiress and her French husband finally arrived in October 2010. Their Lordships’ formulation that “the court should give effect to a nuptial agreement that is freely entered into by each party with a full appreciation of its implications unless in the circumstances prevailing it would not be fair to hold the parties to their agreement” went further than many commentators expected in all but creating a presumption that a properly prepared agreement will be upheld.

Whilst the judgment carefully suggests that it would not be right rigidly to “fetter the flexibility” required to reach a fair result in individual cases, there are a number of applications currently awaiting determination where a prenuptial agreement is being relied upon to score a “knock out blow.” If those applications succeed, and Radmacher principles become entrenched, it raises the prospect of the Law Commission’s final report, due in 2012, arriving too late in the day to influence the long running debate on the rights and wrongs of prenuptial agreements.

The International Angle

The fallout from the 2010 Supreme Court decision in Agbaje which ended the exceptionality of applications under Part III of the Matrimonial and Family Proceedings Act 1984 for financial relief after a foreign divorce has, predictably, seen a string of reported decisions which demonstrate that such relief will now be commonplace. Perhaps the most notable decision was that of Moylan J - upheld by the Court of Appeal - in Golubovich which saw the wife obtain an award under Part III comparable to that which she would have achieved had the divorce taken place here.

Trusts

The Court of Appeal’s decision in Whaley, upholding Baron J’s first instance decision, was a salutary lesson that if trustees fail properly to engage in ancillary relief proceedings where trust assets are in issue they risk a sceptical reception. This in turn can lead to the Court making findings that will justify orders that cannot be satisfied without recourse to trust assets. That was the outcome in Whaley and the Court of Appeal rejected the husband’s argument that such an order put “improper pressure” on the trustees. The perception of trust experts of the failure of the Family Division to respect the integrity of trust structures means that this will not be the last word on the subject. The interface of family law and trust litigation is the subject of a number cases likely to be determined over the next twelve months.

Cohabitation

In February 2011 the President of the Family Division, Sir Nicholas Wall made a robust public call for cohabitants to have financial rights against each other on relationship breakdown. His words came shortly before the Supreme Court considered the case of Kernott v Jones. That case revives the question of the principles that should be applied in dividing the property of unmarried couples. The President made clear his view that the current state of the law, and its strict application of conventional trust principles, can frequently lead to injustice. The decision in Kernott is still awaited and whether the Supreme Court attempts to right the perceived wrongs of the current law or leaves the issue for Parliament remains to be seen.

Children

The legal year ended with the Court of Appeal’s decision in Re K which appears to have rewritten the jurisprudence in relation to applications for permission permanently to remove children from this jurisdiction. The long established emphasis on the impact on the primary carer of a refusal of permission deriving from the Court of Appeal’s guidance in Payne has long been controversial with critics arguing that the guidance has led to an apparent presumption in favour of the parent seeking to relocate and has relegated the importance of the effect on children of the diminution in their relationship with the parent left behind.

A number of recent decided cases appeared to demonstrate that Payne principles had survived such criticism and it seemed that only a Supreme Court case would see a re-evaluation of the law. Re K changed that perception with Black LJ confirming that “the only authentic principle” is that the welfare of the child is the paramount consideration and Payne principles are only guidance, not rigid principles dictating a particular outcome.

The Re K decision firmly rejects the all but presumptive approach in favour of the relocating parent and will doubtless lead to the refusal of many applications to relocate, particularly where there is an element of shared care.
